Mr. Pitha Limjaroenrat Advisor to the leader of the Forward Party along with Mr. Chaithawat Tulathon, leader of the Kao Klai Party Statement of opinions of the Progressive Party after the Constitutional Court ruled on the proposed draft of the Criminal Code Amendment Act (No. ..) B.E. … to repeal Section 112 of the Criminal Code by using it as a policy for campaigning for elections. Mr. Chaithawat said that although the Constitutional Court ruled that the actions of the Kaewkai Party were considered an exercise of rights and freedoms to overthrow the government, But the Progressive Party would like to reaffirm that

We are also concerned that this decision of the Constitutional Court may have long-term effects on Thai politics, such as affecting the power relationship between the legislature and the Constitutional Court in the future.

‘It affects the understanding and meaning of democracy with the King as Head of State. and the main principles of the political system are clear. This may cause things that were done in the past, both during the absolute monarchy or in the democratic regime, to overthrow the government in the present and in the future. It may affect important matters such as the interpretation of what constitutes the overthrow of government. There may be a problem where our understanding of the clear rules does not match. There is ambiguity in terms of interpretation of facts and laws,’ said the leader of the Progressive Party.

Mr. Chaithawat said that the intent of today’s ruling may create problems for the balance b
