The SEC has revealed the prosecution of civil penalties against 9 offenders who created a bid to buy and sell shares of Nation Multimedia Group Public Company Limited (NMG), an industrial company. Electronics Public Company Limited (EIC) and Tong Hua Holding Public Company Limited (TH)

The Securities and Exchange Commission (SEC) receives information from the Stock Exchange of Thailand. And further investigation found that between January – March 2017, there were 9 offenders who had business relationships. and/or have a direct personal relationship or connected through related persons jointly sent trading orders The shares of Nation Multimedia Group Public Company Limited (NMG), Electronics Industry Public Company Limited (EIC) and Tong Hua Holding Public Company Limited (TH) are (1) Mr. Yanyong Intharasongkroh (2) Mr. Panurak Sangaram (3) Mr. Ekawit Kamonthepha (4) Mr. Sirwasit Sainampueng (5) Miss Kannida Tangkittrongcharoen (6) Mr. Phakwan Wongopasi (7) Mr. Kornwich Asawakul (8) Miss Kanchanarat Wongphan
and (9) Mrs. Maliwan Wongchinsri, in the case of creating stock prices for 3 companies by Demand for payment of aggregate civil penalties 33,677,137.50 baht and set a period prohibiting trading of securities and futures contracts. Including being prohibited from being a director or executive. Send orders to buy and sell securities that are in line with and support each other in a way that drives prices. Pairing and trading between each other or sending securities trading orders in a manner that prevents the trading of securities by other persons. Mislead the general public about the price or trading volume of securities and send trading orders in succession. The aim is to cause the price or trading volume of securities to deviate from the normal market conditions. The details are as follows:

In the case of creating NMG stock prices between 30 January – 2 February 2017, a total of 8 offenders were Mr. Yanyong, Mr. Panurak, Mr. Ekawit, and Mr. Sirwasit. Miss Kannida, Mr. Phakwan, Mr. Kornwich and Miss Kanchana

In the case of creating NMG stock prices between 21 – 24 February 2017, a total of 7 offenders were Mr. Yanyong, Mr. Panurak, Mr. Ekawit, and Mr. Sirwasit. Miss Kannida, Mr. Phakwan and Miss Kanchanarat They acted together to cause prices and trading volumes to increase, deviating from normal market conditions.

In the case of creating EIC stock prices between 14 – 15 March 2017, a total of 7 offenders were Mr. Yanyong, Mr. Panurak, Mr. Ekawit, Ms. Kannida, Mr. Phakwan, and Miss Kanchanarat. and Mrs. Maliwan They acted together to cause prices and trading volumes to increase, deviating from normal market conditions.

In the case of creating the price of EIC shares on March 31, 2017 between 10.13.32 – 11.20.59 hrs., there were 7 offenders including Mr. Yanyong, Mr. Panurak, Mr. Ekawit, Miss Kannida, Mr. Phawan, Miss Kanchanarat. sm and Mrs. Maliwan They acted together to cause prices and trading v
olumes to increase, deviating from normal market conditions.

In the case of creating the price of TH stock on 24 March 2017 between 11.48.21 – 14.29.33 hrs., a total of 6 offenders were Mr. Yanyong, Mr. Panurak, Mr. Ekawit, Ms. Kannida, Mr. Phawan and Ms. Kanchana. glory They acted together to cause prices and trading volumes to increase, deviating from normal market conditions.

The actions of the above-mentioned persons are an offense for manipulating the prices of NMG, EIC, and TH shares according to Section 244/3(1)(2) and Section 244/5(2)(3)(5) of the Securities and Exchange Act. .B.E. 2535 with Section 83 of the Criminal Code. which must be punished according to Section 296, Section 296/1 and Section 296/2 and civil penalties according to Section 317/4 and Section 317/5 of the same Act.

The Civil Sanctions Consideration Committee (CSC) resolved to enforce civil sanction measures against all 9 offenders by specifying civil sanction measures as follows:

A. Make the offender pay a civil fine. Compensate
in an amount equal to the benefits received or should have been received. and reimburse the SEC’s expenses due to the investigation of wrongdoing as follows: Mr. Yanyong, amount 7,737,658 baht, Mr. Panurak, amount 3,202,885 baht, Mr. Ekawit, amount 3,201,066 baht, Mr. Sirwasit, amount 3,919,807 baht, Ms. Kannida in the amount of 4,265,567 baht, Mr. Phakwant in the amount of 3,489,821 baht, Mr. Kornwich in the amount of 506,704 baht, Miss Kanchanarat in the amount of 5,048,305.50 baht and Mrs. Maliwan in the amount of 2,305,324 baht.

B. Six offenders, namely Mr. Yanyong, Mr. Panurak, Mr. Ekawit, Ms. Kannida, Mr. Phakwan, and Ms. Kanchanarat, are prohibited. Buy and sell securities or futures contracts for 30 months each and is prohibited from being a director or executive in a securities issuing company or securities company For 60 months each, two offenders are prohibited: Mr. Sirwasit and Mrs. Maliwan Buy and sell securities or futures contracts for 28 months each and is prohibited from being a director or
executive in a company that issues securities or a securities company for 56 months each and prohibits the perpetrator of Mr. Kornwich Trade securities or futures contracts for 14 months and are prohibited from being a director or executive in a securities issuing company or securities company for 28 months.

The civil penalty measures prescribed by the Civil Service Commission under B. will take effect when the offender signs a memorandum of consent to comply with the civil penalty measures prescribed by the Civil Service Commission or when the period of prohibition from being a committee member expires. or executives according to the order of the SEC in accordance with the announcement of the Securities and Exchange Commission No. Kor Jor. 3/2017*, as the case may be.
