“Ratchanee” submits to the Constitutional Court to rule on the Local Election Act

Ratchanee Polsue” submitted a request to the Constitutional Court to rule on the Local Election Act after the Election Commission issued black cards for corruption during the election of the Roi Et Provincial Administrative Organization president. The court ordered the agency to provide 15 days to clarify, along with the qualifications.

The Constitutional Court met and discussed the petition submitted by the Court of Appeal Region 4 to counter Ms. Ratchanee Phonsuea, MP for Constituency 3, Roi Et, Palang Pracharath Party, who objected in the black case number Lt.O.P.O. 1/2567 but the red case number 2391/2567, which requested the Constitutional Court to rule according to the Constitution, Section 212, whether the Act on the Election of Members of Local Councils or Local Administrators 2019, Section 64(4) and Section 65, paragraph one (2) conflict or contradict the Constitution, Section 26 and Section 27 or not.

And the case where the Nakhon Nayok Provincial Court sent the objection of Mr. Kiattikun Suknet,
the defendant in the criminal case number A 159/2567, red case number A 436/2567 and criminal case number A 160/2567, red case number A 437/2567, requesting the Constitutional Court to rule according to the Constitution, Section 212, whether the Election of Members of Local Councils or Local Administrators Act 2019, Section 50(10), which stipulates that a person who has been convicted of a final judgment of committing an offense against his or her official position is a person who is prohibited from exercising the right to run for election as a member of the local council or local administrator, conflicts with or contradicts the Constitution, Sections 26 and 40, in conjunction with Section 5 or not.

In both cases, the Constitutional Court found that for the benefit of consideration, the relevant agencies should prepare their opinions and submit copies of the documents, evidence, and issues that the Constitutional Court has specified to be submitted to the Constitutional Court within 15 days from the date of
receipt of the letter for consideration by the Constitutional Court.

However, for Ms. Ratchanee, the Election Commission previously resolved to propose to the Supreme Court to revoke Ms. Ratchanee’s candidacy and voting rights due to the fraudulent election of the mayor of Roi Et Province in 2022.
