A fourth-year female student filed a complaint with ‘Paveena Hongsakul’ after being forced by police to have sex and pay 10,000 baht in exchange for not pressing charges against her for drunk driving.

Ms. A (pseudonym), 22 years old, a 4th year student at a famous university, filed a complaint with Ms. Paveena Hongsakul, President of the Paveena Hongsakul Foundation for Children and Women, regarding a case in which a police officer, a sergeant on duty at Thanyaburi Police Station, Pathum Thani Province, demanded 10,000 baht and forced her to have sex in exchange for not prosecuting her for drunk driving, threatening that if she did not comply, she would be imprisoned and fined 20,000 baht. When she agreed to do so, the police officer did not give up and blackmailed her to sleep with him again. She could not stand it anymore and decided to seek help from the Paveena Foundation.

Ms. A said that on the night of August 30, 2014, around 11:00 p.m., after drinking with friends and driving home, she hit another s
edan in Khlong Si, Thanyaburi District, Pathum Thani Province. She called the insurance to deal with both parties. She then went to Thanyaburi Police Station, while the other party went to the hospital for a checkup. While at the police station, the police sergeant called her into a room with her and the sergeant. He asked her to blow into the alcohol test. He let her see him blow into it and it came out at 0 milligrams percent. Then he asked her to blow into it and it came out at 103 milligrams percent. The police called her to talk in front of the bathroom next to the building because there were no CCTV cameras. He said, ‘I want you to sign both breathalyzer forms, but I’ll give the form with the result of blowing into zero to the insurance so I can claim to repair the car. But I have to pay him 10,000 baht. If I don’t accept the offer, I’ll go to jail and be fined 20,000 baht.’ She was afraid that she would be prosecuted, so she agreed to do it.

After signing both breathalyzer forms, the police officer as
ked me to write down my personal information, name, surname, address, and contact number, and told me to take a taxi back first. By the time I finished, it was already 2am on August 31st. That day, I gave him the money, but he still hadn’t received it, and he said he would contact me to pick it up and file a police report.

Later, on September 1, 2014 at 2:00 p.m., this policeman drove his personal pickup truck to pick me up at my condo in Rangsit before taking me to file a report at Thanyaburi Police Station, stating that the car accident was caused by my negligence. After that, he drove me back. On the way, he said that he had talked to the duty officer, the sergeant, and the superintendent and that there was no problem. Then he stopped the car and let me withdraw 10,000 baht and handed it to him in the car. I asked for the breathalyzer report that said 103 milligrams percent, which I had signed, but he refused to give it to me.

Until September 2, 2014, he made an appointment for me to meet him at Thanyabu
ri Police Station. He told me to find a quiet place to talk. Then he took me to a restaurant that was like a pub. While we were eating, he forced me to clink glasses and finish the whole glass several times. I tried to beg him to give me the breathalyzer, but he said, ‘I have to sleep with him or he will return it.’ That night, he followed me back to my condo and we had sex. I told him to use protection, but he refused. After we had sex, he still refused to return the breathalyzer, saying that he had always kept every breathalyzer and had never given it to anyone.

The victim continued that she was already suffering from depression. After he returned, she felt very confused, to the point that her symptoms flared up and she had to see a doctor. She was admitted to the hospital for 3 days, from September 3-6. When she returned home, he called her again and said, ‘He’s coming to my condo at 10pm on September 9.’ So, she came to ask for help from the Paveena Foundation.

resident of the Pawina Foundation, took Ms. A to Thanyaburi Police Station to meet Pol. Col. Chirawat Phiampinset, Superintendent of Thanyaburi Police Station, to file a complaint against the police officer. Pol. Col. Chirawat stated that he felt ashamed. If it was true that the police officer had done this to this extent, he would have to take legal action against the police officer to the fullest extent of the law. The latest is that he has ordered her to stop performing her duties and has set up a committee to investigate because her behavior is considered a violation of Section 157.
